Prometheus Radio Project v. FCC

The case of Prometheus v. FCC is an appelate review of the FCC's June 2, 2003 ownership proceeding. This proceeding combined previous FCC proceedings and directives from several court decisions. Some of the issues this case addressed were the National Broadcast Ownership Cap, the Dual Network Rule, the Newspaper Broadcast Cross-ownership, the "Duopoly" Rule, and the local radio competition limits.
On August 13, 2003, MAP's attorneys asked the U.S. Court of Appeals for the Third Circuit to throw out the FCC's media ownership rules on behalf of its client, the Philadelphia-based Prometheus Radio Project. The Third Circuit U.S. Court of Appeals stayed the FCC's order, on September 3rd, 2003 thus preventing the rules from being enforced until court review is complete. Briefs were filed by all parties in the case and oral arguments are now scheduled.
The U.S. Court of Appeals for the Third Circuit heard oral arguments on February 11th, 2004 in Philadelphia.
